Terms of Service

These terms set the ground rules for using D4RKNet websites, applications, and services.

The short version

Use the Services fairly and responsibly.

  • You must be at least 13. A parent or guardian must approve use and purchases where a young person cannot legally agree alone.
  • You keep the rights you hold in your original content and allow D4RKNet to process it to provide the features you use.
  • Do not attack, exploit, misrepresent, or misuse the Services or other people.
  • AI output can be inaccurate or unexpected and should not be treated as professional advice.
  • New Zealand consumer protections and any other rights that cannot lawfully be excluded still apply.

The agreement

These Terms are an agreement between you and Paul Hayden, a sole trader trading as D4RKNet, based in New Zealand. In these Terms, "D4RKNet", "we", "us", and "our" refer to that operator.

They apply to d4rk.net, Mythborne, JobTracker, and any other D4RKNet website, application, or service that links to them, together called the "Services".

By creating an account, selecting an acceptance control, purchasing an entitlement, or using a Service after these Terms take effect, you agree to them. If you do not agree, do not create an account, purchase anything, or continue using the Services. The Privacy Policy explains how personal information is handled.

Product-specific terms below or a written business agreement may add to these Terms. Mandatory law prevails over any inconsistent term. A payment, distribution, or external service provider may also apply its own terms to your relationship with it.

Age and authority

You must be at least 13 to use a consumer Service. If you are under 18, or otherwise cannot enter this agreement alone under applicable law, a parent or legal guardian must review and approve these Terms and your use and purchases. A parent or guardian who approves that use agrees to supervise the account and be responsible for it to the extent permitted by law.

If you use a Service for an organisation, you confirm that you are authorised to act for that organisation. The organisation is also bound by these Terms. You must not create an account or enter information for another person without appropriate authority.

Accounts and security

  • Provide accurate current information and keep it reasonably up to date.
  • Do not sell, share, or transfer login credentials.
  • Keep passwords, verification codes, device sessions, and recovery methods secure.
  • Tell support@d4rk.net promptly if you suspect unauthorised access.
  • You are responsible for activity performed through your account unless it resulted from a failure for which D4RKNet is legally responsible.

D4RKNet may require email verification, re-authentication, a password change, session revocation, or another reasonable security step. Names and profiles must not impersonate another person, infringe rights, or mislead users about authority or affiliation.

Using the Services

D4RKNet grants you a limited, revocable, non-exclusive, and non-transferable right to use the Services in accordance with these Terms. Organisation use may be shared with authorised members through the controls provided by the relevant Service.

Alpha, beta, preview, pilot, and experimental features may be incomplete, change materially, contain defects, or have limited availability and support. D4RKNet may add, change, or remove features to improve a Service, address security or legal requirements, or reflect technical and commercial constraints. Reasonable notice of a material adverse change will be given where practicable and required by law.

The Services are not emergency, medical, legal, financial, accounting, payroll, employment-law, or safety-critical systems. Do not rely on them where an error could cause death, injury, unlawful employment action, or serious loss.

Your content

You retain any rights you hold in original content you submit or create, called "User Content". You give D4RKNet a worldwide, non-exclusive, royalty-free licence to host, copy, format, transmit, display, moderate, back up, and otherwise process User Content only as reasonably needed to provide, secure, support, and improve the features you use, comply with law, and enforce these Terms.

This licence includes allowing relevant service providers to perform those functions for D4RKNet. It ends when the content is deleted, except for protected backups, de-identified records, shared records that other users are entitled to retain, and legal or security records.

You choose who may see content through the sharing and permission controls available in a Service. You authorise D4RKNet to show collaborative content to the campaign members, organisation members, or public-link visitors selected by an authorised user. You must have the rights and permissions needed to submit User Content.

If you voluntarily send feedback or suggestions, D4RKNet may use them without payment or restriction, but will not publicly identify you as the source without permission.

Acceptable use

You must not use or help another person use a Service to:

  • break the law, facilitate fraud, threaten safety, harass others, exploit children, or distribute unlawful or malicious material;
  • infringe privacy, confidentiality, intellectual property, or other legal rights;
  • upload malware, probe vulnerabilities, evade security controls, interfere with availability, or access any account, organisation, campaign, API, server, or data without authorisation;
  • scrape, crawl, reverse engineer, or automate a Service except where law permits it or D4RKNet has given written permission;
  • dishonestly manipulate purchases, credits, refunds, invitations, permissions, results, or other records;
  • sell accounts, credentials, digital entitlements, or Service access outside a feature expressly provided by D4RKNet;
  • impersonate a person or organisation, misrepresent affiliation, or submit information you lack authority to use; or
  • consume resources unreasonably or prevent normal use by others.

D4RKNet may investigate suspected misuse and preserve relevant evidence. Where reasonably possible, enforcement will be proportionate to the risk and notice or an opportunity to resolve the issue will be provided.

Purchases, refunds, and reversals

The product, price, currency, taxes, and entitlement being purchased will be shown before checkout. You authorise the selected payment provider to charge the displayed amount. Android purchases may be processed through Google Play, while supported web and Windows purchases may use Stripe-hosted Checkout.

D4RKNet receives provider references and status information needed to fulfil, reconcile, and support a purchase, but not your complete card number. A purchase is complete only after the provider confirms payment and D4RKNet grants the relevant entitlement.

Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded, including rights under New Zealand's Consumer Guarantees Act 1993 and Fair Trading Act 1986 where they apply. A change of mind does not automatically create a refund right, but payment providers may offer additional rights and D4RKNet may approve a refund where appropriate.

For Google Play purchases, use the Google Play refund process or contact D4RKNet support. For Stripe purchases, email support@d4rk.net with the account, approximate date, and provider receipt reference. Do not send complete card details.

When a purchase is refunded, reversed, disputed, charged back, or found to be fraudulent, its credits or other entitlements may be removed. Transaction and reversal records may remain for an accurate ledger, fraud prevention, accounting, and legal compliance.

Third-party services

The Services may interoperate with or link to Google Play, Stripe, OpenAI, Google or Firebase, Cloudflare, Discord, application stores, address-search services, and other independent services. D4RKNet does not control their availability, content, or independent processing. Their terms apply when you use them. A link does not endorse all content or practices of the linked service.

D4RKNet property

The Services, software, design, branding, documentation, and D4RKNet-created content are owned by D4RKNet or its licensors and are protected by applicable law. Except for the limited right to use the Services, no right or licence is granted. You must not remove proprietary notices or use D4RKNet, Mythborne, or product names, logos, or artwork in a way that suggests endorsement without permission.

Open-source components remain governed by their own licences. Those licences prevail for the relevant component where they grant rights inconsistent with this section.

Suspension, termination, and deletion

You may stop using a Service at any time and may request account deletion through an available account control or support@d4rk.net. The account deletion page explains the available process. Deletion may not remove de-identified shared, transaction, audit, security, or legally required records.

D4RKNet may restrict, suspend, or terminate access where reasonably necessary to protect users or systems, investigate a credible security or legal issue, address non-payment, comply with law, or respond to a material breach of these Terms. Where the situation permits, notice, an explanation, and a reasonable opportunity to resolve the issue will be provided.

D4RKNet may discontinue a Service. Reasonable advance notice will be given where practicable, together with available information about exports, deletion, and paid entitlements. Statutory consumer rights continue to apply.

Service quality and statutory rights

D4RKNet will provide the Services with reasonable care and skill and honour guarantees and remedies required by applicable law. Subject to those obligations, the Services are provided on an "as available" basis. D4RKNet does not promise uninterrupted operation, immediate correction of every defect, accurate AI output, or that a Service will meet requirements that have not been agreed.

You are responsible for maintaining appropriate copies of information you cannot afford to lose and for checking important output, exports, workplace records, and purchasing decisions. Maintenance, internet failures, provider outages, device limitations, and events beyond reasonable control may affect availability.

Liability

Nothing in these Terms limits liability or rights where doing so would be unlawful. These Terms do not exclude applicable New Zealand consumer guarantees, liability for fraud or wilful misconduct, or another liability that cannot legally be limited.

To the maximum extent permitted by law, D4RKNet is not liable for indirect or consequential loss, loss of profit, revenue, opportunity, goodwill, or data, or loss caused by unauthorised use of your credentials, third-party services, User Content, or use contrary to these Terms. This exclusion does not apply where applicable law requires D4RKNet to compensate the loss.

For an organisation or other business user, and only where permitted by law, D4RKNet's total liability relating to an affected Service in any 12-month period is limited to the greater of NZD $100 and the fees that organisation paid for that Service during that period. This business limitation does not apply to liability that cannot legally be limited. The Consumer Guarantees Act is not contracted out of unless D4RKNet and the business customer expressly agree in writing and the legal requirements for doing so are satisfied.

Problems, disputes, and governing law

Email support@d4rk.net first and describe the Service, account, issue, and outcome sought. D4RKNet will try to investigate and resolve the issue reasonably. Privacy complaints are handled under the Privacy Policy.

You may use any complaint, tribunal, regulator, payment-provider, or court process available under applicable law. Nothing in this section requires a consumer to give up a statutory remedy.

These Terms are governed by New Zealand law. You and D4RKNet submit to the non-exclusive jurisdiction of the New Zealand courts. This does not remove mandatory consumer or privacy protections, or a right to bring a claim, that applies in the country where you live.

Product-specific terms

Mythborne

AI-assisted features and credits

Mythborne may send your instructions and relevant campaign or character context to AI providers to produce narrative, summaries, images, or other requested output. You authorise that processing when you use an AI-assisted feature.

AI output is probabilistic and may be inaccurate, incomplete, offensive, unexpected, non-unique, or unsuitable for your purpose. Review output before relying on, publishing, or sharing it. D4RKNet does not claim ownership of output generated for you, but output may not qualify for intellectual property protection and may be subject to third-party rights or provider terms.

Do not use AI features for decisions about a person's employment, credit, insurance, housing, healthcare, legal rights, or other high-impact matters. Do not submit confidential or sensitive personal information that is unnecessary for the feature.

  • Mythborne credits are limited digital entitlements usable only for designated Mythborne features.
  • Credits are not money, stored value, a deposit, or an investment. They earn no interest and cannot be redeemed for cash or traded for real-world value.
  • Purchased, granted, and spent credits are recorded in the account ledger. A provider-confirmed refund, reversal, dispute, chargeback, or fraudulent purchase may remove the corresponding credits.
  • If credits have already been used, a reversal may produce a negative balance. Later credits may first restore that balance, and purchasing or credit-consuming features may be restricted while it remains negative.

JobTracker

Organisations and workplace information

An organisation controls which authorised accounts may access its JobTracker workspace and records. Owners and users with delegated permissions may invite or remove members, assign access, enter or update information, and review activity history.

An organisation using JobTracker must have lawful authority for information it enters, provide required privacy and workplace notices, keep records reasonably accurate, restrict access appropriately, and independently verify records before relying on them for employment, payment, safety, legal, tax, or operational decisions.

JobTracker does not replace professional employment, payroll, tax, health and safety, accounting, or legal advice. Displayed plan, price, and billing terms will apply to paid organisation features when introduced.

Changes, general terms, and contact

D4RKNet may update these Terms to reflect Service, provider, or legal changes. The current version will remain at this address. Reasonable advance notice of a material change will be given through the relevant Service or by email where practicable and required. A change will not retroactively remove rights in a completed purchase.

  • If a term is invalid or unenforceable, it will be read down or removed only to the extent necessary. The remaining Terms continue.
  • A delay in enforcing a term is not a waiver.
  • You may not assign your account or this agreement without written permission. D4RKNet may transfer the agreement as part of a genuine business transition, subject to applicable law and continued protection of your rights.
  • Headings and the short summary help readability but do not change the complete Terms.
  • These Terms, the Privacy Policy, applicable product terms, and any written business agreement form the agreement about the Services.
